Agreement to Terms

By accessing or using SucculenCare mobile application and website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

Definitions

• "Service" refers to the SucculenCare mobile application and website
• "User," "you," and "your" refer to the individual accessing the Service
• "We," "us," and "our" refer to SucculenCare
• "Content" refers to all text, images, data, and other materials available through the Service

Use of Service

Eligibility

You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

Account Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload harmful code or malware
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service for any illegal or unauthorized purpose

Subscriptions and Payments

Subscription Plans

SucculenCare offers three subscription tiers:

• Free Plan: Limited features at no cost
• Premium Plan: $4.99/month with enhanced features
• Pro Plan: $9.99/month with all features

Billing

• Subscriptions renew automatically unless canceled
• You will be charged at the start of each billing period
• Prices are subject to change with 30 days notice
• All payments are processed securely through Stripe
• No refunds for partial months or unused features

Cancellation

You may cancel your subscription at any time through the app settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the subscription expires.

Free Trial

Premium and Pro plans include a 7-day free trial for first-time users. You will not be charged during the trial period. Cancel before the trial ends to avoid charges.

Intellectual Property

Our Content

The Service and its original content, features, and functionality are owned by SucculenCare and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content

You retain all rights to the content you upload (photos, notes, etc.). By uploading content, you grant us a license to:

• Store and display your content within the Service
• Process your content to provide Service features
• Use anonymized data to improve AI accuracy (with your permission)

AI Features Disclaimer

Our AI plant identification feature is provided "as is" for informational purposes:

• Identification accuracy is approximately 98% but not guaranteed
• Care recommendations are general guidelines, not professional advice
• Always verify plant identification with multiple sources
• We are not responsible for plant health outcomes
• Consult a professional botanist for medical or toxic plant concerns

Limitation of Liability

To the maximum extent permitted by law, SucculenCare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or plant health, resulting from your use of the Service.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users
• Is harmful to the Service or our business
• Violates applicable laws

Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
